1. INTRODUCTION

Welcome to Classroom Hero! These Terms of Use ("Terms") govern your access to and use of the Classroom Hero application, website, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.

1.1 Acceptance of Terms

By creating an account, accessing, or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using the Service on behalf of an educational institution, organization, or other entity, you represent and warrant that you have the authority to bind that entity to these Terms.

1.2 Who May Use the Service

Classroom Hero offers different types of accounts:

• Administrator Accounts: For school or district administrators who purchase teacher seats
• Teacher Accounts: For educators managing classroom reward systems
• Parent Accounts: For parents/guardians monitoring student progress
• Student Accounts: For students participating in classroom reward systems

Student accounts for children under 13 require parental/guardian consent in accordance with the Children's Online Privacy Protection Act (COPPA).

2.1 Service Description

Classroom Hero provides a digital classroom management platform that allows teachers to:

• Define point-earning actions for students
• Create virtual marketplaces for students to spend earned points
• Track point deductions through "Subtractors"
• Set and monitor class-wide goals
• Access AI tools and educational chatbot features

Students can:

• View earned points and class information
• Customize virtual avatars using earned points
• Participate in classroom reward systems

3. ACCOUNTS AND REGISTRATION

3.1 Account Creation

To use certain features of the Service, you must register for an account:

• Teacher/Parent/Administrator Accounts: Require valid email address and password, or authentication through Google or Apple social login.
• Student Accounts: Created with temporary access codes provided by teachers and do not require email addresses.

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

3.3 Account Termination

You may terminate your account at any time through the account deletion feature available in your account settings. We may suspend or terminate your account if you violate these Terms.

Upon account termination:

• You will lose access to all content and features associated with your account
• We will retain your data for 30 days to allow for account recovery before permanent deletion

4. PRIVACY AND DATA PROTECTION

• iOS subscriptions processed through Apple's in-app purchase system

6.2 Avatar Accessory Purchases

We offer one-time purchases of avatar accessory packs:

• Web purchases processed through Stripe
• iOS purchases processed through Apple's in-app purchase system

6.3 Payment Terms

By subscribing to Classroom Hero:

• You authorize us to charge the applicable fees to your designated payment method
• Subscription fees are billed in advance on a recurring basis

8.3 AI Tools Disclaimer

The AI tools and chatbot features provided within Classroom Hero:

• Are provided for educational and administrative assistance purposes only
• May not be suitable for all educational contexts or age groups
• Should be used under appropriate teacher supervision
• May occasionally generate content that is inaccurate or inappropriate despite our safeguards

9. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Classroom Hero from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of the Service.

10. CHANGES TO TERMS

We may modify these Terms at any time by posting the revised terms on our website. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.

11. TERMINATION

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms.
